Dumbass, I don't think this recommendation was just for you. Many people love the bigger ladies so a comment like this is really not necessary. For what reason did you have to reply to this thread?

This sounds fake to me. Has anyone else heard anything about this? Besides, I didn't even know there were any other forums related to SP's in winnipeg.

Outcall Prostitution is legal in Canada HotAC (Section 212 of the criminal code of Canada).

Before making a statement like that you should do some research! Here is the link PLEASE DO YOUR HOMEWORK! - http://laws.justice.gc.ca/en/C-46/section-212.html

Illegal

-In calls (Common bawdy house)

-Pimping (Living off the Avails of prostitution - not the girl she can live off the avails this is to remove the pimp element)

-Public Solicitation (Procuring - Discussing sex for money in public - it's legal in private here in Canada)

-Under age (18 years)

Legal

-Sex for money

-Private discussion of the exchange of sex for money

-outcalls

What you should know about "Licensed Escorts"

-A license for an escort usually means they agree that no sex is to be exchanged for money. This is a license to "Escort" only as the municipalities do not want to be pimps. This gives the municipalities a way to pass out bi-law infractions to people who advertise as an escort in the municipality and do not have a license. It does NOT make it legal to exchange sex for money - in fact the license the girl signs is giving the municipality a way to police her (well.. not real police - bi-law officers who often power trip on the girls). Licensing is WRONG and they use it as a way to remove escorts from the city... they make the license's really high priced and act like police to try to scare the ladies. It's disgusting!!

Most likely this was the Winnipeg BI-LAW officers! NOT POLICE - Winnipeg is pushing the licenses to scare the girls out of town and the bi-law officers are acting like police and using scare tactics on the ladies. They prey off the fact that the girls don't usually know any better because they do not know they have rights. It's very sad and disturbing. They will probably get bi-law tickets (Like parking tickets - no criminal record and no jail or anything) but the bi-law will probably threaten them and tell them that if they don't get a license they will get the police involved... since prostitution is legal in Canada in a outcall situation the police will not get involved unless drugs, pimps or underage escorts are involved. We just need to educate the community (Hobbiests and escorts) so that they know what the laws are and the girls need to know they have rights!!

So have there been any cases of bi-law officers in Winnipeg "staking out" SP's in-call locations in order to bust their clients?

I have 2 parts to this post

First

I'm a little confused mod:

In one part you mention that it is legal to get sex for money, then in another part of your e-mail you mention that the license does NOT make it legal to exchange sex for money. I guess this is where i am a little confused.

Second:

Maybe the two individuals mentioned could respond and set the record straight as to the validity of the posting.

Yes Both Symone and myself were busted last night. Apparently a few others too. Don't know who as my appointment was for 8pm and hers was for 1 am.

They were police, they were the vice. They weren't city bylaw unless they wear police vice jackets and carry handcuffs.

I spoke to Symone today. Her bust was different then mine, we also had two different guys.

I arrived at about 6 minutes to 8pm. He opened the door and invited me in, I gave him a big hug and kiss. I asked if he was ready to have me get changed. He really wanted to go down to the lounge and have a drink. I was suggesting room service instead. He wanted to get out of the room and get to know each other. We went and had a beverage. he had said he was from AB. I questioned the 204 area code, he said his work supplied him with a cell phone, so why not use it when they foot the bill.

We made small chit chat. He asked me about girls and anal, and do the girls ask for more money for that. I said I don't know. As my ad states I don't play games in greek. He was asking me way to many questions that I did try to avoid. He told me his first time was in mexico with a girl that only charged 200 and had her for most of the day. he mentioned my rate was higher for a shorter period of time. All I did was smile.

We finished our drinks and headed back to his room. We got off on the 5 th floor and walked by the room beside his and he talked quit loudly. The next thing you know I'm hearing Winnipeg city police vice unit, Holly you are under arrest. They handcuffed me. I said dang I knew this was going to happen, cause earlier before I had left to go to the hotel I called a girlfriend and said I had a funny feeling about this.

She joking suggested I bring some board games. I should have followed my gut. But lesson learned. My so called client went into his room grabbed my bag of goodies, that I'm sure the vice had already looked through. He looked at me said I'm very sorry and handed my bag to the vice cops.

I was escorted (no pun intended) out a side door, but I was still seen by many people. It was truly embarrassing. They put me in the car and drove to another near by hotel. Which is where they read me my rights and also gave me a court date along with a few tickets to produce to a magistrate. where I will receive my fines.

They are doing it because of the licensing and the fact of nudity on the EC site. Apparently that's not allowed.

I have this option to go to a 3 day hooker camp, and all my charges dropped and no record.

Which is the route I'm going. I go in August. Long time away but who knows why their reasons are for that.

Symone was very different then mine. I won't post hers. I'll let her do if she so decides to.

Yes it is a scare tactic. I felt like it was entrapment. But regardless I'm calm and not going to get all worked up over it.

I did ask if I had been singled out, they in a round about way said many were happening that night.

I think we left the parking lot because more then likely another was going to arrive shortly.

As they rushed with Symone. Telling her another one was coming. Some girls don't read the boards so can't say for sure if this is true or making an assumption.

I know it was my bad To go down to the lounge with him, as we were in a public place. He was the one mentioning things. I tried to avoid most of his questions.

I do have to mention that they were very nice, literally, we even joked around a bit.

NO... Bi-Law officers are NOT police. They can not bust the customers. If it's a in-call location the RCMP can charge you for being in a common bawdy house but that is very rare as it required public complaints and a fluke chance you are in the location at the time of the bust.

When you buy a "Escort License" from the city you agree that SEX WILL NOT be part of the service and if caught having sex with clients for exchange of money you can loose your license. (It's a ploy!)

If you do not get a "Escort License" and market yourself as a "Service Provider" then you simply tell them you are not a escort you are a prostitute and out call prostitution is legal in Canada so you have no right to force be to purchase your escort license.

If I was to have said I'm a prostitute and not an escort would I have not gotten the fines?

I told them I was a service provider. Their response was yes a service provider on an Escort site, with nudity. Apparently nudity is forbidden on an escort site.

Too bad Canada does not have any ENTRAPMENT laws!! This is sneaky as he brought you into a PUBLIC place and tricked you into talking about sex in public so you can be charged with public solicitation! How disgusting is that!

They are doing it because of the licensing and the fact of nudity on the EC site. Apparently that's not allowed.

They actually told you that!? Unreal! It's not illegal to post nude (especially topless) photos of yourself online and I know of no law that says you can not post nude photos on a website in order to promote your business. It would be interesting to see what a judge would say about this! I am going to make a call to our lawyer and see what he thinks of that.

I know it was my bad To go down to the lounge with him, as we were in a public place.

Good lesson to share with others. DO NOT TALK ABOUT SEX FOR MONEY IN PUBLIC - this law was created to enforce street walkers and they are abusing the law by trapping the girls like this. I think a judge would throw this out of court but the offer for a 3 day camp is probably what most of the girls would agree to in order to escape any chance of a criminal record for public solicitation.

Not if it's a public solicitation charge. If you discussed sex in public to a police officer then you are guilty of public solicitation. If you said "We can discuss this privately in your room" and not said anything in public then you would have escaped the charge.

I told them I was a service provider. Their response was yes a service provider on an Escort site, with nudity. Apparently nudity is forbidden on an escort site.

I am not aware of any such law. Now the municipal by-law for "Escorts" probably has information about not advertising with nudity and if you do then you could loose your escort license or be fined a bi-law infraction for this if you are a municipal license holder. If you tell them you are not a escort but a service provider (or better yet a prostitute) then the license does not apply to you and since EC has ads for Massage, male escorts, dating sites, etc... and not just advertising for escorts then they can not say you are a escort. You can advertise your business anywhere you see fit (that will allow you to advertise) if you wanted to sell a car on escorts-canada they would sell you advertising for this and that would NOT make you an escort. If they tell you this they are just BS'ing you and bulling you around! SexSearch is one of our major advertisers, since they advertise on escorts-canada does that make them a escort? NO! Those accusations are just unreal and would not hold up in court! But I am sure they know this and are playing off the fact the no service provider will take them to court... they will just bow down and take it.

Yes I have a ticket here, that reads " As operator of Holly Raye a dating and escort service did distribute or cause to be distributed an advertisement showing or depicting any nude male or female body parts. To Wit five photos of exposed breasts."

It's unfortunate , he did most of the talking. I did a lot of smiling. I really feel it was entrapment.

The 3 day camp sounds like fun. they have a pool and crafts and many things to do. they even have someone come in and give facials, and manicures.

They offer a lot of resources for the girls at this camp that will help with how to recognize a bad date, lawyers will be there as well as vice, ex workers etc. So it could be very beneficial.

This sounds like a BI-LAW ticket and not a criminal charge. They can probably ticket you for breaking the "Escort" by-law if you show nudity but you would need to hold a "Escort" license. If they charged you with public solicitation then that alone proves you are not an escort. If you hold a municipal escort license then they can TICKET you under the provisions of that by-law. Read the by-law and I am sure you will find that nude advertising is not permitted if you are an escort.

Well Mr.Mod, if it's so fucking legal, why did she get pinched???

No Money was exchanged. The Cop baited her right to the end asking loaded questions. Lied where he was from as well.

Also lied about the cell phone area code.

Will also lie like a sidewalk in court.

I think you should bring that excerpt from the Criminal Code of Canada you quoted and represent Holly in court. Tell the courts that "Prosituiton is Legal in Canada"

I highly dought you will win.

Do you actually read the threads or just respond blind? God - waste everyone's time. Read the thread... she got lured into going outside of the private hotel room down into the public lounge. Public solicitation is illegal (I will dumb it down for you here - discussing sex acts in public is illegal and she was tricked into talking about sex for money in the hotel bad). Since we do not have any entrapment laws in Canada this is legal but I would hope any Judge would throw this out as the initial arrangment was made in private and he conned her into doing this.

Tell the courts that "Prosituiton is Legal in Canada" I highly dought you will win.

We know you can read so click the link I sent you and read the law yourself. If it's over your head google it and you will find some websites that dumb it down for you .

Here is a big court case right now from Valerie Scott. Here is a quote

"The act of prostitution itself is legal in Canada, yet the provisions challenged in this application operate to deny sex workers safe legal options for the conducting of legal business," the statement reads.

http://www.cbc.ca/canada/story/2007/03/21/sexworkers-challenge.html

... read the law, educate yourself and then come back and have a intelligent discussion with me about this but until you can back up a bold statement like that so you can be sure you don't give someone bad information (Like you did) these ladies deserve better!

Thank you, that is very interesting to know.

When I go in front of the magistrate I will be bringing that up. Bring my court paper with me that states "Communicate for the purpose of engaging in prostitution". They should disregard that ticket, am I correct?

I've been doing this for years, I should have known better. I just guess when it was happening I went into my own little world. I stayed very calm.

I have no idea if they will drop it but it's worth a try. The good thing about by-law infractions is that if you fight it you actually get to go in front of a real judge. People are afraid of judges but they know the law and they know your rights and a good judge will not allow moral issues to influence his/her decision. You should bring a copy of the municipal by-law with highlighted parts that pertain to this case. (Especially the part where they define a "escort")... you would say "I do not fit into your definition of a "Escort" as I am a sex worker. It is legal in Canada to exchange sex for money and if you force me to pay a license fee to be a licensed escort your by-law stops me from doing my job legally so I will not agree to pay for a license. If I need a license in your city to be a sex worker aka "Service provider" then I would gladly pay that license fee."

If they say you advertise on a escort site and point out escorts-canada.com you can bring print outs of the site with pages that people describe sex acts that are available, ads for sites like sexsearch (Adult dating site) ads like "Red Confidence" (how to pick up women website) etc... and say "These companies and people are also advertising on escorts-canada... does this make them escorts? Your definition for the word "Escort" is incorrect as many people associate this term with prostitution and you definition clearly states that it is not a person who sells sexual services and that is what I am. If you are saying I am a escort by your definition because I advertise on this website then everyone on this website must be an "Escort" and you can clearly see that is not the case."

Bottom line is... until they change the definition of "Escort" to include sexual acts then you do not fit the definition.... they will NOT change it because if they did they woudl force you to pay a license fee to have SEX for MONEY then they would be living off the AVAILS and be PIMPS ... This would be breaking the law under the criminal code of Canada's section 212 entitled "Living off the Avails of prostitution"! The city lawyers would never allow the city to do this!

....they are being bullies, preying on your lack of knowledge of the law, using scare tactics to make you pay them so they can police you further... and in Canada prostitution is legal (if you follow the law) so they are infringing on your rights! Register your business, pay your taxes and follow the law and you can have a legal prosperous business.

Winnipeg's licences for escorts are just a polite way for the provincial government to get there cut of Winnipegs booming sex trade.

Here is how the con works.....

your sick and tired of working for these so called "Escort Agencies" Who take a large portion of you money and make you do all the work(SEX) so you decide you want to work for yourself.

Your an indepentent provider who would like to take time to get there license to protect themselves and there clients.

You go to the board and say you are an escort and would like to be licensed

Then they tell you that only agencies can be licensed at that will cost $4000

then you have to get a license to be an escort for your own agency who you own which is yourself for $105....

So basically you if you want to have a license you must work for a PIMP or become a pimp, and pimp yourself.......

The reason why they want use to work for a PIMP/ESCORT AGENCY

is because when you own a agency you have to keep a client list, that can be asked to be produced to the police at anytime, as well as the get to collect those SO SO LARGE TAXES!!

So that's the roundabout way that Winnipeg makes thousands of dollars a year from legal prostitution.........

BUT I HAVE A GOOD F-U for Winnipeg bi-laws.....

let say "what if" we incorporated ourselves as indepentent companions and model contractors, that would be legal, we would be a legal buisness minus the $4000 and become employed by ourselves...... providing a chance to save a pention and live a legal life..................................for once......
