Is it illegal to run a professional agency

Hi everybody.

 

I have searched everywhere on the internet to find out if running an agency in nova-Scotia is legal. Does anyone know the answer? I can't seem to find anything for Nova-Scotia.

I am not a lawyer, but I'm not aware of any provincial or municipal regulations regarding escort agencies in Nova Scotia.

 

Criminal Law is the jurisdiction of the Federal Government, so of course the provisions of the Criminal Code of Canada apply to Nova Scotia. For example, to be legal, any agency in Canada has to conform to the current laws regarding Bawdy Houses (in-calls) and Procurement (including living on the avails, etc.).

I am not a lawyer either however I reviewed the prostitution laws in Canada and oversea extensively before deciding to hobby and WIT is correct. The current prostitution law is under Federal jurisdiction and it is only legal for clients if they receive the sex worker (outcalls). As far as agency, it would likely violate the Procurement law mentioned by WIT and if it offers incall services (i.e. booking a hotel room for the client to visit) it also likely violates the Bawdy house law. That said, in my view (and again I am not a lawyer) if an agency operates professionally, that is to represent the lady rather than rule over them and treat them right and be careful about public solicitation and lady's age, then it could be very low risk to run such agency, but still likely not legal anywhere in Canada as the law stands now.

If you are serious about owning/running an agency, best thing to do, contact a lawyer. Everyone here can have opinions and their interpetation of the laws, but to be safe, get a lawyer to navigate you through the laws...not just those pertaining to prostitution, but to those pertaining to setting up a business

Nowhere in the Criminal Code it is mentioned that it's a criminal act to run an agency. "Escort agency" is not a term define by law, neither escort! These words first flourished in the sex industry subculture and are now of commun use.

 

However, if we agree that:

 

-agency implies management

 

-that managing implies one of the following:

 

  • recruitment
  • advertisement
  • booking
  • transportation
  • promotion
  • solicitation
  • etc...

 

And that

-escorting implies "prostitution" and "illicit sexual intercourse"

 

And that

-prostitution equal sex in exchange of money

however, as of today, there are no court consensus in regards of what sex implies in that context: a HJ, FS, BJ, licking body parts? Neither is clear what "illicit sexual intercourse" means.

 

It means that:

-A person performing one of the managment tasks mentionned above who happends to receive a financial compensation for her labour iscometting an offense in regards of Canadian prostitution laws - mainly living on the avails or keeping a bawdy house.

 

Such as the anti-choice women -self identifying as abolitionist feminists- the law makes no difference weither you are a nice employer or a crook. You are a criminal. You are "procuring". You are exploiting. You are what we refer to in popular culture as a Pimp!

 

So no, I don't believe opening a "Professional agency" in Nova Scotia is legit. As mention by others, it is of Federal juridiction, it does not matter where you are in Canada.
